This week the Oklahoma Legislature completed their first week of committee work to hear bills from the opposite chamber. Upcoming legislative deadlines are as follows:

Budget Discussions
Budget discussions between House Appropriations and Budget Committee Chairman Earl Sears, R-Bartlesville, and Senate Appropriations Committee Chairman Paul Myers, R-Ponca City, are underway. Deeper funding cuts for state agencies are expected than proposed by Governor Mary Fallin.
According to Rep. Sears, the cuts could range between 5 and 7 percent instead of 3 to 5 percent because legislators have not yet embraced the two of the Governor’s key funding ideas:
- Streamlining state government operations, consolidating agencies and cutting most state agencies’ budgets 3 to 5 percent; and
- Moving to a two-year motor vehicle registration system for noncommercial vehicles and two $100 million bond issues to free up money that can be spent on other services.
With Republicans controlling both the Legislature and Governor’s office, it’s hoped a budget agreement will be reached mid-April, a month earlier than recent years.

Health Care Exchange
Last week, the House voted 51 to 34 to advance House Bill 2130 by Speaker Kris Steele, R-Shawnee, and Senator Clark Jolley, R-Edmond. HB 2130 defines the membership and appointments to the Health Care for the Uninsured Board (HUB), which will oversee the implementation of the health care exchange. Health insurance exchanges set up a means – probably through a website – for consumers to learn about, compare and purchase health insurance. Exchanges organizing the marketplace for consumers, especially those who don’t have health insurance, want it and don’t qualify for Medicaid or Medicare.
If federal health-care legislation is fully implemented, people who earn no more than 400 percent of the poverty level would qualify for tax credits to help pay for insurance purchased through exchanges. According to documents put out by the Oklahoma Council of Public Affairs, 48 states have accepted $1 million or more in federal grant money to begin implementing an exchange.
Governor Fallin received criticism this week from fellow Republicans for her support of HB 2130, saying the proposal is the first step to implementing ‘Obamacare’ in Oklahoma. The Governor, however, said health care exchanges are inevitable by 2013 if the federal health bill is enacted, and it is good protocol for the state to set up a system prior on its own terms. The state has accepted $54 million in federal funding to establish its exchange.

Lawsuit Reform
Senate Bill 862 by Senator Anthony Sykes, R-Moore, and Rep. Dan Sullivan, R-Tulsa, passed the House Judiciary Committee this week 10 to 5. If signed into law, the bill will eliminate joint and several liability. The measure will protect defendants from judgments that exceed their liability. SB 862 will ensure that defendants remain responsible for the portion of damages to which they are at fault. It goes to the full House for consideration.
Senate Bill 865 by Senator Sykes and Rep. Sullivan also passed the House Judiciary Committee. SB 865 would require that juries in professional negligence cases be told that damages awarded in the case are not subject to federal or state income taxes. It goes to the House floor as well.

House Bill 2128: Legislation that places a $350,000 cap on non-economic damages has passed Senate Rules Committee 11 to 5. House Bill 2128, by House Speaker Kris Steele, R-Shawnee, and Senator Anthony Sykes, R-Oklahoma City, does not impact damages such as lost wages, medical expenses and future loss of expected wages. The bill also lays out exceptions to the cap cases of gross negligence, reckless disregard, intentional actions, or malicious conduct. House Bill 2128 will now proceed to the Senate floor.

Immigration
House Bill 1446: The Senate Judiciary Committee approved House Bill 1446 by Rep. George Faught, R- Muskogee, and Senator Ron Justice, R-Chickasha, 6 to 3. HB 1446 would give federally trained state and local law enforcement officials more authority to check the immigration status of motorists. HB 1446 includes part of Arizona‘s anti-illegal immigrant law passed last year. It has been referred to the Senate Appropriations Committee.

Water
Senate Bill 248 by Senator Kim David, R-Wagoner, and Rep. Wade Rousselot, D-Wagoner, awaits approval from the House Agriculture, Wildlife and Environment Committee. SB 248 would allow Rural Water Districts to take “raw” or untreated water from the lakes or
tributaries under the control of the Grand River Dam Authority for free. Rural Water Districts have
previously been required to buy water from the GRDA, which is a state agency. Oklahoma Rural Water
Districts are by statute also agencies of the State of Oklahoma. They function to provide safe drinking water

Economic Development
Aerospace Tax Incentive: Bill 1008 by Rep. Skye McNiel, R-Bristow, and Senator Mike Mazzei, R-Tulsa, unanimously passed the Senate Finance Committee with the title stricken. This bill would restore the aerospace engineering tax incentives, which will help grow the industry in Oklahoma and create new jobs. HB 1008 now heads to the Senate for consideration.
The aerospace tax was included in a list of tax credits targeted for a two-year moratorium by lawmakers and the governor last session. The tax credits allow aerospace engineers to receive some tuition reimbursement if they come to work for a company in Oklahoma within one year of graduation. The law also grants a tax credit to an aerospace company for compensation paid to a qualified employee.
Education
School Performance: Senate Bill 348 by Senator Clark Jolley, R-Edmond, and Rep. Lee Denney, R-Cushing, which would assign letter grades to schools, has passed the House Common Education Committee 10 to 5. Failing schools would be put on a plan of improvement. SB 348 is exclusive to school sites and not school districts. The title remains off the bill.
Senate Bill 445: Rep. Jabar Shumate proposed an amendment to Senate Bill 445 by Senator John Ford, R-Bartlesville, and Rep. Lee Denney, R-Cushing, during the House Common Education Committee Meeting. The amendment, which passed 11 to 4, would clarify that students would not be required to obtain a transfer from the school district to move to a charter school within the current school district they were in.
Corrections
Senate Bill 137 by Senator John Ford, R-Bartlesville, and Rep. Lee Denney, R-Cushing, adds Bachelors and Associates degrees to the achievement credit programs within the Department of Corrections. Currently, inmates only receive credits when they attain their GEDs. There are 29 inmates enrolled at Rose State and 26 enrolled at Seminole State who were on the honor roll. The bill passed the House Public Safety Committee 16-0.
Insurance
Senate Bill 411 by Senator Bill Brown, R-Broken Arrow, and Rep. Lewis Moore, R-Arcadia, passed the House Insurance Committee 6 to 4. SB 511 establishes a new law directing the Oklahoma Department of Insurance and State Department of Health to establish and maintain a comprehensive health care information system. This would allow consumers to see pricing information from different insurance providers. The Insurance Department would be develop and maintain a website with pertinent information. The fiscal impact is estimated at $640,00 for start-up cost and $320,000 annually to maintain.
