This week at the Oklahoma Legislature marked the second week of House and Senate bills being heard in the opposite chamber. Next week is the final week for bills to be considered in the opposite house. Those bills not being heard on the respective floors will be dead for this legislative session.
Upcoming legislative deadlines are as follows:
- April 22, 2010 - House and Senate – Final Legislative Day for Third Reading and Final Passage of a Measure in Opposite House of Origin
- May 28, 2010 - House and Senate – Sine Die Adjournment, no later then 5:00 p.m.
March Revenue Tops Prior Year Collections and Estimate
State revenue collections in March topped prior year collections for the first time since December 2008 and exceeded the official estimate for a second consecutive month, State Treasurer Scott Meacham announced this week. Preliminary reports show General Revenue Fund collections in March were $401.3 million. That amount is:
- $6.4 million or 1.6 percent above the prior year; and,
- $81.4 million or 25.5 percent above the estimate.
March collections were sufficient to fund allocations to state agencies for the month at the previously announced 10-percent reduction from appropriated levels. After allocations are made, $80.1 million in excess collections will remain for use in later months this fiscal year.
Gross production taxes on oil and gas continued to drive improvements in the revenue picture. However, an upswing in personal income tax collections also improved the picture substantially. The State Treasurer said sales taxes continued to lag behind the estimate and prior year, but is hoping to see improvements as public confidence increases.
Budget Negotiations
Legislative leaders, who are still working toward a budget agreement, cautioned while revenue numbers were improving, it would have little immediate impact to the current budget shortfall and negotiations.
The State Treasurer, chief budget negotiator for the Governor, said some computer models show the FY 2011 budget will still need to be cut by more than 7 percent. The Governor’s office is advocating several areas of revenue enhancements be used to avoid double-digit cuts to some areas of government.
Enhancements that have been proposed enhancing tax collections of online sales, eliminating some tax credits, suspending or capping other credits over the course of the downturn and lowering the amount of the rebate paid to retailers for collecting sales tax.
However, Senate Pro Tem Coffee and Speaker Benge have showed little support for what they describe as “raising taxes” in a downed economy.
The current budget gap is more than $500 million for FY 2011, even with using federal stimulus money and funds from the state’s constitutional reserves (Rainy Day funds).
Education
OSU Med Center Supplemental Funding – HB 2445 by Rep. Miller and Sen. Johnson passed the Senate this week, which allows for the second $5 million payment to continue the financial commitment made last year to the Oklahoma State University Medical Authority in Tulsa for FY 2010. The funds are part of a public-private agreement reached with local and state leaders last year, where the state’s contribution is $5 million a year for five years.
Those funds will be matched by at least an annual $7 million commitment for the next five years in private funds dedicated within the Tulsa community. The funds will go to the Oklahoma State University Medical Authority, which contracts with the City of Tulsa, OSU Med Center Trust for the operation of the hospital with St. John. The bill passed the Senate this week and was sent to the Governor for consideration of signing into law.
Higher Ed Capitol Improvements Bond Restructure: HB 3031 by Speaker Benge and Sen Coffee - Gov. Brad Henry signed this measure into law this week, which is designed to reduce a backlog of almost $365 million in the state’s endowed chairs program for Oklahoma colleges and universities. The bill authorizes the restructuring of a $100 million bond issue approved in May 2008 to generate additional resources to help match private donations to the program. The bonds should be issued by late summer. Of the $100 million, 47 percent each will go to OU and OSU and 6 percent will be used for other state schools.
Transportation
Gilcrease Expressway: HB 3220 by Speaker Benge and Sen. Bingman – Authorizes construction of a new turnpike beginning at I-44 & 49th West, past Highway 64/412, turning NE, crossing 41st W, and continuing eastward to the L.L. Tisdale Expressway in Tulsa. The measure would put the project on a list of approved toll roads. The Turnpike Authority would have to vote on whether to build it. This bill was passed by the Senate this week and has been sent to the Governor for consideration of signing into law.
Distracted Driving: HB 2276 by Rep. Duncan and Sen. Anderson – will allow law enforcement to cite drivers who drive dangerously while using their cell phone, but prohibit them from initiating a traffic stop simply for operating a cell phone. The measure amends current law to require law officers to observe driving that “poses an articulable danger to other drivers. The Governor signed the legislation this week.
Task Force on the Motor Vehicle License Plate Delivery System: SB 1954 by Sen. Anderson and Rep. Jackson - Creates the Task Force on the Motor Vehicle License Plate Delivery System, for the purpose of studying the delivery of services relating to motor vehicle registration and renewal, including the impact of online renewal. The Senate refused to concur on House amendments. The measure will now go to Conference Committee.
Public Safety
Meth Registry Bill: HB 3380 by Rep. Terrill and Sen. Sykes – The Oklahoma State Bureau of Narcotics and Dangerous Drugs Control shall create and maintain a registry of those convicted of methamphetamine possession or manufacture. Passed in the full Senate and now returns to the House for consideration of Senate amendments and will then head to a conference committee.
Workers’ Compensation
CompSource Task Force Extension: HB 2658 by Rep. Sullivan and Sen Coffee - extends the date of Task Force on Privatization of CompSource Oklahoma. The House refused to concur in Senate amendments so the measure will now go to Conference Committee.
Agriculture
At Risk Farms/Ranches: HB 2791 by Rep. Kouplen and Sen. Garrison - Clarifies criterion for the definition of an “at-risk farm or ranch business” by including a production loan limit to $250,000. Updates the name of the State Dept. of Agriculture to OK Dept. of Agriculture, Food, and Forestry. The House refused to concur in Senate amendments so the measure will now go to Conference Committee.
Oklahoma Livestock Care Standards Board: HB 2345 by Rep. Richardson and Sen. Justice – Creates the Oklahoma Livestock Care Standards Board for the purposes of establishing standards governing the care and well-being of livestock and poultry in this state. The House refused to concur in Senate amendments so the measure will now go to Conference Committee.
Teeth Floating: HB 3202 by Rep. Armes and Sen. Schultz – Defines “Animal Husbandry” and “Teeth Floating”, and provides exemptions for such under the Oklahoma Veterinary Practice Act restrictions. This bill was signed by the Governor on Friday, April 16th.
Economic Development & Financial Services
Banking Department Reforms: HB 2779 by Rep. Ownbey and Sen. Stanislawski - Modifies the requirements of the Deputy Commissioner of the Banking Dept and stipulates procedures of the Commissioner regarding failed banks and savings associations. House Bill 2779 makes a number of changes to the Department of Banking, many of which will improve the agency’s procedures. The legislation has no cost, but will streamline several notification requirements, as well as make other improvements. HB 2779 contains a number of provisions:
- Expands qualified candidates for the position of Deputy Commissioner to include employees of the Department of Banking with a minimum of five years experience;
- Prohibits third party access to special and routine examinations and reports in the possession of a financial institution that is under the Department’s purview;
- Requires that the Commissioner’s annual report to the Governor be published on the Oklahoma State Banking Department’s website, eliminating the requirement to produce 25 copies;
- Authorizes the Banking Board, at a closed meeting, to approve an acquiring bank’s organization for a bank or savings association that is in danger of failing;
- Authorizes the Commissioner to grant a certificate of authority without a Board hearing in such an event;
- Requires Commissioner to take possession of a bank in danger of failing, upon Board approval, at a closed meeting;
- Authorizes the Board to order the Commissioner to submit to the Federal Deposit Insurance Corporation (FDIC) the appointment as liquidator of the bank;
- Authorizes the Board to consider the Commissioner’s recommendations directed at improving the failing bank’s conditions; and
- Allows applicants seeking to re-organize a failed bank or company an opportunity to correct deficiencies in such application;
- Requires public notice of acceptance of application;
HB 2779 was signed into law by the Governor this past week.
Small Business Owner Protection Act – Lawsuit Reform: HB 2946 by Rep. Fred Jordan and Sen. Anderson - Requires a plaintiff to notify the defendant an assertion that a facility does not comply with applicable law, codes and standards regulating construction 120 days prior to filing a petition for civil action. Voted from the Senate and was sent to the Governor for consideration of signing into law.
City and County Trusts – SB 1631 Sen Mike Mazzei and by Rep. Fred Jordan - Relates to authorized activities of municipalities and county trusts and clarifies that Wholesale and retail outlets could be included in any purpose according to the act. Voted from the House 96 to 2 and was sent to the Governor for consideration of signing into law.
Commerce Boomerang Program: SB 1881 by Sen. Lamb and Rep. McNiel - Directs the Oklahoma Department of Commerce to maintain a website dedicated to the Boomerang Program. Senate refused to concur on House amendments. The measure will now go to Conference Committee.
REAP Reforms: HB 3291 by Rep. McNiel and Sen. Justice - Allows Rural Economic Action Plan Funds to be spent in areas with less than 7,000 people. Was passed in the Senate and now will return to the House for consideration of Senate amendments and will now head to a conference committee.
General Government
Oil and Gas Liens: SB 1615 by Sen. Bingman and Rep. Trebilcock - Extends an oil and gas lien to each interest owner of oil and gas rights. The lien shall become effective immediately upon passage of the bill, in the amount of interest that the owners have. Passed the full Senate and sent to the Governor for consideration of signing into law.
Oklahoma Discretionary and Special Needs Trust Act: HB 2171 by Rep. McCullough and Sen. Anderson - Creates the Oklahoma Discretionary and Special Needs Trust Act provides provisions applying to trusts regardless of a spendthrift provision. The House refused to concur in Senate amendments so the measure will now go to Conference Committee.
Alarm/Locksmith Committee: HB 2320 Rep. Steve Martin and Sen. Coates - After May 1, 2011, members appointed to the “Alarm and Locksmith Industry Committee” could serve two terms. An agreement was reached with the Alarm and Locksmith industry and the electrical and plumbing contractors. The Senate passed the bill unanimously and now will go to the Governor for consideration of signing into law.
Intangible Property Tax: HJR 1061 by Representative Chris Benge and Senator Glenn Coffee sends the right of the State to tax intangible property to a vote of the people. The title is off the bill as it heads to the Senate floor next week and will be sent to a conference committee.
