This week marked the Senate deadline for House bills in Senate committees to be heard. Upcoming legislative deadlines are as follows.

Budget Progress Slow for FY 2011
This week also marked the midpoint of the 2010 legislative session with little word on how lawmakers plan to address the shortfall in the FY 2011 state budget. Much of the first several weeks of the legislative session were committed to closing a more than $700 million hole in the current year’s state budget. That resulted in cuts averaging about 7.0 percent to nearly all state agencies. Next year’s cuts could range from 10 to 12 percent on top of already reduced state budgets.
Governor Henry weighed in with remarks this week stating that balancing Oklahoma’s budget by just making additional cuts to agencies will have “irreparable and damaging” effects on state services. The governor has proposed about $725 million in revenue enhancements as an alternative. Proposals include refinancing bond issues at today’s lower rate, eliminating and suspending tax credits; and taxing more Internet sales that are made in Oklahoma.
House budget officials said the state could still have a deficit of about $500 million to $600 million after using $223.5 million from its savings account, the Rainy Day Fund, and the remaining $515 million of stimulus funds. Legislators have about $1.2 billion less to spend this year compared with last year. Low energy prices and the economic recession have caused revenues for the state to come in about 26 percent below estimates so far this fiscal year.
Most of the state agencies started the fiscal year, which began July 1, with a 7 percent budget cut. As revenues came in under budget, most state agencies received another 7.5 percent across-the-board cut.
The 2011 fiscal year budget is the lowest since the $5.36 billion budget for 2005.
The Senate will begin hearing bills on the floor this week, while the House has another week to hear bills from the opposite chamber in committees before their floor work begins.
Healthcare
Oklahoma Medical Loan Repayment Program: HB 1043 by Rep. Sears and Sen. Crain - provides educational loan repayment assistance for up to 6 licensed primary care doctors per year, if they agree to practice in certain communities. Passed Senate Appropriations and now heads to the full Senate. The title is off this bill.
OSU Med Center Supplemental Funding – HB 2445 by Rep. Miller and Sen. Johnson – Makes an appropriation of $5,000,000 to the OSU Medical Authority for FY 2010. It was reported from Senate and House GCCA committees and will now be considered on the House and Senate floors, likely this week.
Chronic Pain Management: SB 479 by Sen. Jolley and Rep. Trebilcock – Creates the “OK Plan for Comprehensive Treatment of Chronic Obstructive Pulmonary Disease Act”. Changes the definition for long-term care administrator, requiring them to hold a license by OK State Board of Examiners or Nursing Home Admin. The bill was passed by the House this week and now heads to the Governor his consideration signing into law.
Abortion Restrictions: SB 1890 by Sen. Lamb and Rep. Sullivan – forbids an abortion based solely on the sex of the child. The bill passed the House with a vote of 95-1, was sent to the Governor for consideration for signing into law.
Freedom of Conscience Act: SB 1891 by Sen. Sykes and Rep. Peterson – allows health care professionals to refuse to take part in performing an abortion. The bill passed the House with a vote of 80-13, and was sent to the Governor for consideration for signing into law.
RU-486: SB 1902, by Sen. Jolley and Rep. McNiel, makes it illegal for a person other than a physician to provide or administer the chemical abortion pill, RU-486, for the purposes of inducing an abortion. The bill passed the House with a vote of 91-7, and was sent to the Governor for consideration for signing into law.
Athlete Concussions: SB 1700 by Sen. Anderson and Rep. Cox – Prohibits youth athletes suspected of sustaining a concussion from returning to activities until evaluated by a licensed health care provider who is trained in concussion evaluation and management. Voted from committee and now heads to the full Senate.
Education
Charter School Expansion: HB 2753 by Pro Tem Coffee and Rep. Lee Denney – Authorizing school districts, technology center school districts, and comprehensive or regional institutions in the State System of Higher Education to sponsor charter schools, provided the charter school is located in a school district that has a school site on the school improvement list. The bill passed Senate Education, and now heads to the full Senate.
Student Records Reporting: SB 2211 by Sen. Jolley and Rep. Cox – provides that any school district failing to comply with state requirements for a student record system would be stripped of state funding. The bill passed House A&B Committee, and will now go to the full House for consideration on the floor.
Agriculture
Teeth Floating: HB 3202 by Rep. Armes and Sen. Schultz – Defines “Animal Husbandry” and “Teeth Floating”, and provides exemptions for such under the Oklahoma Veterinary Practice Act restrictions. This bill passed the Senate and now goes to the Governor for consideration for signing into law.
Economic Development & Financial Services
Small Business Owner Protection Act – Lawsuit Reform: HB 2946 by Rep. Fred Jordan and Sen. Anderson – Requires a plaintiff to notify the defendant an assertion that a facility does not comply with applicable law, codes and standards regulating construction 120 days prior to filing a petition for civil action. Voted from Senate Judiciary committee and now heads to the full Senate.
Compulsory Insurance Law: HB 2331 by Rep. Steve Martin and Sen. Reynolds – Requires officers to verify compliance with the Compulsory Insurance Law online during all traffic stops and requires that anyone found or believed to be in violation or otherwise barred from driving have their vehicle towed and seized. Voted from Senate Appropriations committee and now heads to the full Senate.
Annexation: HB 3236 by Rep. Jackson and Sen. Newberry – Allows business districts to annex adjacent property by a vote of those to be annexed. Allows business districts to be assessed to fund capital improvements of the district. Voted from Senate Business & Labor committee and now heads to the full Senate.
Revisions to Oklahoma Economic Development Pooled Finance Program: HB 3286 by Rep. McNiel and Sen Lamb – allows the Oklahoma Development Finance Authority to maximize their issuing capacity of the two $100 million fixed pools by allowing the reduction of principal when bonds are retired and refresh their issuing capacity. This will be accomplished with no fiscal impact to the state. The bill allows ODFA to issue its obligations in order to provide net proceeds on a pooled basis not to exceed one hundred million dollars for the Infrastructure Pool or for the Economic Development pool. Voted from Senate Finance committee and now heads to the full Senate.
REAP Reforms: HB 3291 by Rep. McNiel and Sen. Justice – Allows Rural Economic Action Plan Funds to be spent in areas with less than 7,000 people. Voted from Senate Appropriations committee and now heads to the full Senate.
Tax Credit Reforms: HB 3397 by Rep. McNiel and Sen. Lamb – Amends expenditure requirements of qualified investments before a tax credit can be authorized. Voted from Senate Finance committee and now heads to the full Senate.
Intangible Ad Valorem: HJR1061 by Speaker Benge and Pro Tem Coffee – Constitutional Amendment to create the Task Force on Taxation of Intangible Ad Valorem Property. Voted from Senate Finance committee and now heads to the full Senate.
Development Impact Fee: SB 805 by Sen. Aldridge and Rep. Hickman - Establishes the Oklahoma New Development Impact Fee Act. Voted from House A&B Sub on Rev and Tax committee and now will be considered by the full House A&B Committee. The title is off the bill.
Debit Cards: SB 1648 by Sen. Jolley and Rep. Miller – Adds debit cards to the Uniform Consumer Credit Code. Passed the House and now heads to the Governor for signing into law.
Construction Industries Board: SB 1872 by Sen. Coates and Rep. Jordan – Obliges that the Construction Industries Board include the explicit plans and specifications in their requirements of an application for project review prior to bid dates, and clarifies language in relation to such applications. Voted from House Econ Dev & Finance committee and headed to the full House.
Insurance Commission Documents: SB 2054 by Sen. Brown and Rep. Sullivan - Insurance Commissioner may require documents to be filed electronically. Eliminates certain fees associated with mailed documents. Provides for the repeal of Oklahoma Small Employer Health Reinsurance Program. Voted from House Econ Dev & Finance committee and now heads to the full House.
Public Safety
Meth Registry Bill: HB 3380 by Rep. Terrill and Sen. Sykes - The Oklahoma State Bureau of Narcotics and Dangerous Drugs Control shall create and maintain a registry of those convicted of methamphetamine possession or manufacture. Voted from Senate Appropriations committee and now heads to the full Senate.
Transportation
Gilcrease Expressway: HB 3220 by Speaker Benge and Sen. Bingman – Authorizes construction of a new turnpike beginning at I-44 & 49th West, past Highway 64/412, turning NE, crossing 41st W, and continuing eastward to the L.L. Tisdale Expressway in Tulsa; Voted from Senate Transportation committee and now heads to the full Senate.
Vehicle Registration Reform: SB 1651 by Sen. Aldridge and Rep. Banz – Car dealers must provide vehicle registration documentation within ten days of selling a vehicle, or be liable upon written request of the consumer to pay any fines accrued for driving an unregistered vehicle. This bill was not heard in House A&B Sub on Revenue & Taxation.
Electronic Car Tags: SB 1769 by Sen. Coates and Rep. Gus Blackwell - Creates pilot program for electronic issuance of temporary license plates for use by motor vehicle dealers. Licensed used motor vehicle dealers are exempt from this legislation. Voted from House A&B Subcommittee on Gen. Gov and Transportation and now will be considered by the full House A&B Committee.
Aircraft Protection Act: HB 2919 by Rep. Shannon and Sen. Myers – Creates the Aircraft Pilot and Passenger Protection Act. The construction of a structure used for a noise sensitive purpose within a noise sensitive area constitutes an incompatible use of land near a public use airport. Voted from Senate Appropriations committee and now heads to the full Senate.
General Government
Alarm/Locksmith Committee: HB 2320 Rep. Steve Martin and Sen. Coates – After May 1, 2011, members appointed to the “Alarm and Locksmith Industry Committee” could serve two terms. Voted from Senate Bus and Labor and now heads to the full Senate and the title is off the bill.
Fiscal Impact Bills: HB 3054 by Speaker Benge and Sen. Lamb – Requires that bills which would have a direct adverse fiscal impact be assigned to the respective Senate/House standing committee or subcommittee that is primarily responsible for bills pertaining to municipalities. Lien Reforms: SB 1686 by Sen. Coates and Rep. Sullivan – Amends current language to liens. Pre-lien notices must be provided within 75 days of the last furnishing of materials, services, labor, or equipment. Requirements do not apply to claimants whose aggregate claim is less than $10,000.
