This week in the Oklahoma Legislature, Committees in both the Senate and House have completed their work of passing through bills for a full vote in their house of origin. Any bill not heard in Committee is now considered dead and will no longer show in your bill tracking reports.
Also this week, the House passed multiple bills implementing the fiscal year 2010 budget agreement reached between the Governor and legislative leaders. The bills will now move to the Senate for consideration before going to the Governor for signature. Below is a review of action taken on legislation this week multiple areas of public policy that are at the forefront of legislative debate.
Transportation
County/City Population Limit: HB2646 by Rep. Fred Jordan allows the Department of Trans. or a county board of commissioners, with agreement from the gov. of a municipality of less than 5,000 people to maintain and build streets in the county. The bill passed out of Committee and now heads to the House Floor.
Gilcrease Expressway: HB 3220 and SB 1764 by Sen. Bingman and Speaker Benge. Both bills authorize construction of a new turnpike beginning at I-44 & 49th West, past Highway 64/412, turning NE, crossing 41st W, and continuing eastward to the L.L. Tisdale Expressway in Tulsa. Both bill passed out of their house of origin and will now be heard in the opposite chamber.
Turnpike 2/3 approval: SB 1773 by Sen. Randy Brogdon – Requires a concurrent resolution with 2/3 approval of both Legislative Houses prior to the Oklahoma Turnpike Authority issuing certain turnpike revenue bonds or changing toll amounts, beginning November 1, 2010. The bill was passed out of Committee and now goes to the Senate floor.
Economic Development & Financial Services
Enhancing the Oklahoma Economic Development Pooled Finance Program: HB 3286 by Rep Skye McNiel Last year, the legislature passed HB 2067, which has already resulted in successes such as Hitachi Computer Products of America Inc.’s recent decision to break ground on a $15 million, 200,000-square-foot expansion project in Norman. The revisions to the Oklahoma Economic Development Pooled Finance Program in HB 3286 will allow the ODFA to maximize their issuing capacity of the two $100 million fixed pools by allowing the reduction of principal when bonds are retired and refresh their issuing capacity. This will be accomplished with no fiscal impact to the state.
Workforce Tax Credit: HB 3287 by Rep. Skye McNiel This bill aims to incentivize the recruitment of workforce draught areas such as engineers in the Economic Developing Generating Excellence (EDGE) areas such as agriculture, biology/biotechnology, genomics, weather science and technology, and telecommunications. The bill passed out of House Appropriations and now heads to the House floor.
Wrecker MV Display: HB 2326 By Rep. Steve Martin presents conditionality regarding the off-site display of new upfitted motor wrecker vehicles by manufacturers/dealers as well as permit and locations requirements pertaining to their sale. The bill passed out of Committee and now heads to the House Floor.
Vehicle Total Loss Sale: HB 3213 by Rep. Charles Ortega prohibits insurers from offering cash settlements for the purchase of a comparable motor vehicle and then subsequently selling the motor vehicle which has been deemed to be a total loss back to the claimant.
Energy
Energy Stabilization Fund: HB 3032 by House Speaker Chris Benge aims to reduce the impact energy price volatility has on state revenue collections. The legislation creates an automatic collection of any gross production taxes above a simple three-year average for deposit into a newly created Energy Stabilization Fund. In years when gross production taxes collected fall below the three-year average, the fund will automatically deposit the difference into the state’s general revenue fund to help mitigate budget shortfalls. The bill now goes to the House floor.
Wind Energy Development: HB 2973 by Rep. Mike Sanders creates the Oklahoma Wind Energy Development Act to establish and regulate wind energy standards. The bill passed unanimously out of Committee and now heads to the House floor.
